FBA Foundry provides limited-capacity professional education, mentorship, consulting, research and customized advisory services.

FBA Foundry does not market or offer trial periods, satisfaction guarantees, money-back guarantees or discretionary refund programs as an inducement to purchase. Our no-refund terms are disclosed upfront so that you can evaluate the Service and ask any questions before committing.

Because our Services require us to reserve limited availability, allocate capacity and, where applicable, prepare or perform work specifically for each purchaser, all sales are final and all payments are non-refundable once payment has been successfully processed and the order is confirmed, except where a refund or cancellation right is expressly stated in writing for a particular offer or is required by applicable law.

For purposes of this Policy, your commitment begins when your payment is successfully processed and your order is confirmed. It does not depend on whether you have submitted an intake form, scheduled a session, accessed materials or begun actively participating in the Service.

Please review the applicable offer carefully and contact us with any questions before submitting payment.

1. All Sales Are Final

Unless a specific offer expressly states otherwise, FBA Foundry does not offer refunds, credits or cancellations after payment has been successfully processed and the order has been confirmed.

This applies regardless of whether you later:

  • change your mind;
  • decide that you no longer wish to participate;
  • decide that the Service is no longer convenient for you;
  • choose not to use the Service;
  • fail to complete an intake form;
  • fail to provide requested information;
  • fail to schedule or attend a session;
  • fail to participate in a mentorship program;
  • experience a change in your personal, business or financial circumstances;
  • choose not to implement recommendations provided;
  • become unavailable to participate; or
  • determine after payment that you would prefer to spend your money elsewhere.

Submitting payment for a Service represents a firm commitment to that Service and to the capacity reserved for you.

2. Why Our Services Are Non-Refundable

FBA Foundry does not operate as an unlimited-access, self-service digital-product marketplace.

Our Services are capacity-constrained and may involve individualized analysis, consulting, mentorship, research, feedback, preparation, scheduling, support or other resources reserved specifically for purchasers.

Once your payment is successfully processed and your order is confirmed, FBA Foundry may immediately:

  • reserve limited availability for you;
  • remove or reduce availability that could otherwise be offered to another purchaser;
  • allocate consulting, mentorship, research or review capacity;
  • begin onboarding or administrative work;
  • provide access to program materials or systems;
  • reserve future sessions or program participation; and
  • prepare to perform the Service associated with your order.

Because this capacity is limited, accepting your order may mean that the same capacity is unavailable to another customer.

For these reasons, the financial commitment becomes final when payment is processed and the order is confirmed and is not conditioned on whether you later choose to use, participate in or complete every component of the Service.

3. 1:1 Strategy Sessions and Appointments

Payments for private consulting calls, strategy sessions and other appointment-based Services are final and non-refundable.

FBA Foundry maintains limited availability for private sessions. Once payment and booking are confirmed, consulting capacity is reserved for that purchaser and may no longer be available to another customer.

Accordingly, no refund is provided because you:

  • cancel the appointment;
  • change your mind;
  • fail to attend;
  • arrive late;
  • fail to provide requested information;
  • decide you no longer need the consultation; or
  • are unable to attend for personal or business reasons.

Any ability to reschedule a session is subject to the rescheduling terms presented with the applicable booking or, where no specific rescheduling policy is stated, may be permitted at FBA Foundry's discretion.

Permission to reschedule does not create a refund right.

The availability of a last-minute appointment does not change this Policy. A session booked shortly before its scheduled time remains a final, non-refundable sale once payment and booking are confirmed.

4. Product Selection Reviews and Other Customized Services

Payments for a Product Selection Review, product analysis, brand analysis or other customized research or review Service are final and non-refundable.

Upon payment confirmation, FBA Foundry reserves review, research and service capacity for your order.

These Services require information from the purchaser in order for us to perform the applicable individualized work. You are responsible for completing and submitting the required intake form and providing the information reasonably necessary to perform the Service.

Failure to submit an intake form or provide required information does not cancel the order, delay the point at which your financial commitment becomes final, or create a refund right.

Where intake information is required before substantive analysis can begin, the applicable delivery or turnaround period begins after FBA Foundry receives the completed information reasonably required to perform the Service.

Your delay in submitting required information will correspondingly delay delivery and does not constitute a delay, failure or breach by FBA Foundry.

If you cannot locate your intake form, you are responsible for contacting [email protected] so that we can provide or resend it.

5. Mentorship Programs

Payments for FBA Foundry group mentorship, private mentorship and similar programs are final and non-refundable.

Enrollment reserves one of a limited number of available program positions and allocates mentorship, support and program capacity to that purchaser.

Your financial commitment becomes final when payment is successfully processed and your enrollment is confirmed, regardless of whether the program or your individual participation begins at a later time.

Accordingly, no refund is provided because a participant later:

  • changes their mind;
  • chooses not to begin;
  • stops participating;
  • does not attend available sessions;
  • does not complete program materials;
  • does not submit requested information;
  • does not implement recommendations;
  • does not use available support;
  • experiences scheduling conflicts; or
  • is dissatisfied with their own business results.

Enrollment provides the right to receive or access the Services described in the applicable offer. It does not condition payment on whether the participant elects to use every available component.

6. Intake Forms and Required Customer Information

Certain FBA Foundry Services require an intake form or additional information from you before some or all individualized work can be performed.

Submitting required information is your responsibility as the purchaser.

Intake forms may be:

  • displayed immediately after checkout;
  • delivered through an online portal; and/or
  • sent to the email address provided during payment.

You are responsible for providing a valid email address, monitoring that account, checking spam or junk folders where appropriate, locating applicable intake instructions and contacting FBA Foundry if you cannot locate them.

Failure to submit an intake form does not mean that your order has been cancelled, that the Service has not been reserved for you, or that a refund is due.

Capacity reservation, onboarding, administrative processing and other applicable aspects of the Service relationship may begin immediately upon payment confirmation even where substantive individualized work cannot begin until you supply required information.

No refund is due merely because a purchaser fails or declines to provide information necessary for FBA Foundry to complete the customized portion of the Service.

7. Failure to Use a Service

A Service is not refundable merely because you do not use it.

If FBA Foundry reserves, provides or makes available the purchased appointment, program, mentorship capacity, research capacity, access, support or customized Service in accordance with the applicable offer, your failure or decision not to use it does not convert the transaction into a refundable transaction.

This includes unused:

  • consulting sessions;
  • mentorship calls;
  • program access;
  • support;
  • educational materials;
  • review capacity;
  • research capacity; or
  • other included Services.

8. Business Results, Expectations and Satisfaction

Refunds are not based on subjective satisfaction, business performance or financial results.

FBA Foundry does not promise or guarantee revenue, profit, product performance, sales, Amazon rankings, account approval, advertising performance, return on investment or any other specific business result.

A purchaser's disagreement with a recommendation, personal dissatisfaction with advice, decision not to implement a recommendation, or failure to achieve a desired business result does not create a refund right.

You are encouraged to review the applicable offer description and ask questions before paying if you are uncertain about what the Service includes.

Nothing in this Policy excuses FBA Foundry from materially providing the Service actually purchased.

9. Payment Plans

Where FBA Foundry allows a fixed purchase price to be paid through installments, the installment arrangement is a method of paying the agreed total price and is not a month-to-month cancellation option or subscription unless the applicable offer expressly states otherwise.

The no-refund policy applies equally to Services paid:

  • in full; or
  • through an installment payment arrangement.

Stopping participation, failing to use the Service, failing to submit an intake form, requesting cancellation or initiating a payment dispute does not by itself eliminate remaining payment obligations associated with a fixed-price purchase.

If a scheduled installment payment fails, FBA Foundry may suspend access to ongoing Services until the account is brought current, subject to applicable law.

10. Billing Errors and Duplicate Charges

This Policy applies to valid and authorized transactions.

If you believe you were accidentally charged more than once for the same transaction, charged an incorrect amount, or that another genuine payment-processing error occurred, contact [email protected] promptly so that we can investigate.

A verified billing or processing error will be corrected as appropriate.

Correcting a genuine billing error is different from requesting a discretionary refund for a valid transaction.

11. Payment Disputes and Chargebacks

If you believe there is a genuine problem with a transaction or Service, we encourage you to contact [email protected] promptly so that we can investigate and attempt to resolve the matter.

A chargeback or payment dispute does not itself create a contractual refund right under this Policy or change the terms to which you agreed.

FBA Foundry will contest payment disputes where our records reasonably demonstrate that a transaction was authorized, the applicable policies were disclosed and accepted, capacity or Services were reserved or provided, or the claim made in the dispute is otherwise inconsistent with the documented transaction.

Depending on the circumstances, evidence submitted in response to a dispute may include:

  • transaction and payment records;
  • proof of authorization;
  • checkout records;
  • the applicable offer page;
  • the Terms & Conditions;
  • this Refund & Cancellation Policy;
  • evidence that applicable policies were presented before payment;
  • evidence of your affirmative acceptance of applicable terms;
  • IP address, device or timestamp information where available;
  • appointment or capacity-reservation records;
  • onboarding records;
  • intake forms;
  • email-delivery records;
  • course, portal or account-access records;
  • program participation records;
  • session bookings and attendance;
  • recordings where lawfully made;
  • communications between you and FBA Foundry;
  • research, preparation or customized work performed;
  • deliverables provided;
  • evidence that Services were made available; and
  • other information reasonably relevant to the dispute.

False or Misleading Disputes

You agree not to knowingly submit false, fabricated or materially misleading information in connection with a payment dispute or chargeback.

If FBA Foundry reasonably believes that a dispute contains materially false information or misrepresents authorization, policy acceptance, access, participation, reservation of capacity, work performed or Services provided, we may preserve relevant records and exercise the rights and remedies lawfully available to us.

Nothing in this provision restricts a legitimate good-faith payment dispute or any right that cannot legally be waived.

Access During a Payment Dispute

Because a payment dispute may result in the disputed funds being withdrawn from FBA Foundry while the dispute is pending, FBA Foundry may suspend any undelivered or ongoing access, sessions, support or Services associated with the disputed payment while the matter is unresolved, to the extent permitted by applicable law.

If the disputed payment is restored or otherwise resolved, FBA Foundry may restore applicable remaining access or Services as appropriate.

Amounts That Remain Legally Owed

A chargeback is a payment-network process and does not necessarily determine every contractual or legal issue between the parties.

Where, after taking into account the outcome of a payment dispute and applicable law, an amount remains validly and legally due under your agreement with FBA Foundry, FBA Foundry reserves the right to pursue lawful recovery through available contractual, collection or legal remedies.

Any such recovery will be pursued only to the extent permitted by applicable law and applicable payment-processor and card-network rules.

FBA Foundry will not re-charge a payment card for a previously charged-back transaction without authorization or where doing so would violate applicable processor or card-network rules.

12. Questions Before Payment

We want purchasers to understand what they are committing to before submitting payment.

If you have a question about:

  • what a Service includes;
  • whether a Service is appropriate for your situation;
  • timing;
  • availability;
  • deliverables;
  • program structure;
  • scheduling; or
  • this Refund & Cancellation Policy,

please contact us before paying.

We are happy to clarify reasonable questions before an order is submitted.

Once payment has been successfully processed and your order is confirmed, uncertainty, misunderstanding or a later change of preference that could reasonably have been clarified before payment does not by itself create a refund right.

13. Rights Required by Law

Nothing in this Policy limits any refund, cancellation, withdrawal, billing-dispute or other right that applicable law does not permit the parties to waive.

Any such right applies only to the extent required by applicable law.

This provision does not create any additional refund, cancellation or withdrawal right beyond what applicable law actually requires.

14. Changes to This Policy

The version of this Refund & Cancellation Policy presented in connection with your payment applies to that transaction.

We may update this Policy prospectively as our Services, business practices or legal requirements change.
