8. Sale, Sharing and Targeted Advertising
FBA Foundry does not sell personal information for money.
However, certain privacy laws define terms such as “sale,” “sharing,” “targeted advertising” or “cross-context behavioral advertising” more broadly.
As a result, disclosures of online identifiers, website activity or other information to advertising or analytics providers may be considered a sale, sharing or targeted-advertising activity under the laws of certain jurisdictions even though FBA Foundry does not receive money in exchange for that information.
Where applicable law gives you the right to opt out of such activity, we will provide an appropriate method for exercising that right.
Where required, this may include a “Your Privacy Choices,” “Do Not Sell or Share My Personal Information,” or similar mechanism.
Where applicable law requires us to recognize browser-based opt-out preference signals, such as Global Privacy Control, we will process those signals in accordance with applicable requirements.
9. Payment Processing
Payments may be processed by third-party payment processors such as Stripe.
Payment processors may collect information necessary to authorize and process a transaction, including payment-card and billing information, in accordance with their own privacy policies and security requirements.
FBA Foundry generally receives transaction information and limited payment-method information rather than your complete payment-card number or card security code.
We may retain transaction information as reasonably necessary for:
- accounting;
- payment administration;
- tax obligations;
- fraud prevention;
- refunds;
- chargebacks;
- payment disputes;

- legal recordkeeping.

You may unsubscribe from marketing emails by using the unsubscribe link included in those communications.
Where SMS, telephone or another marketing channel requires separate consent, we will request that consent where required.
Opting out of marketing does not prevent us from sending transactional or Service-related communications reasonably necessary to administer:
- a purchase;
- payment;
- appointment;
- account;
- program;
- customer-service request; or
- existing customer relationship.
11. Legal Bases for Processing
Where laws such as the European Union or United Kingdom GDPR apply, we may process personal information under one or more lawful bases, including:
Performance of a Contract

Legitimate Interests
Where processing is reasonably necessary for purposes such as:
- operating our business;
- improving our Services;
- maintaining appropriate records;
- preventing fraud;
- providing customer support;
- securing our systems; and
- protecting or exercising our legal rights,
provided those interests are not overridden by your applicable rights and interests.
Consent
Where you have consented to particular processing, including where consent is required for certain marketing, cookies or advertising technologies.
Legal Obligation
Where processing is necessary to comply with applicable law, tax obligations, accounting requirements, court orders, regulatory requirements or other legal obligations.
Where processing relies on consent, you may withdraw that consent subject to applicable law.
Withdrawal of consent does not affect processing that was lawful before consent was withdrawn.
12. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes for which it was collected and for legitimate business, contractual and legal purposes.
Retention periods may differ depending on the nature of the information and why it is processed.
For example:
- transaction, payment, tax and accounting records may be retained for the period reasonably necessary to satisfy legal and recordkeeping requirements;
- agreements, intake forms, service-delivery records and communications may be retained for a reasonable period after the customer relationship ends in order to maintain business records and resolve potential disputes;
- payment-dispute, chargeback and fraud-prevention records may be retained for as long as reasonably necessary to protect against or respond to disputes or improper activity;
- marketing information may generally be retained until you unsubscribe, withdraw consent where applicable, or the information is no longer reasonably necessary; and
- analytics information may be retained according to applicable provider settings and retention periods.
We may retain information for a longer period where reasonably necessary or permitted to:
- comply with applicable law;
- satisfy tax or accounting obligations;
- enforce agreements;
- resolve disputes;
- prevent fraud; or
- establish, exercise or defend legal claims.
When personal information is no longer reasonably necessary for the purposes described above, we may delete, anonymize or de-identify it, subject to information retained in backups or where continued retention is permitted or required by law.
13. Data Security
We use reasonable administrative, technical and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration or disclosure.
These safeguards may include:
- access restrictions;
- authentication controls;
- secure third-party platforms;

We will not unlawfully discriminate against you for exercising an applicable privacy right.
Privacy requests may be submitted to: [email protected]
Verification of Requests
To protect your information, we may take reasonable steps to verify your identity before fulfilling a privacy request.
Information submitted for verification will be used for that purpose and for related security or fraud-prevention purposes.
If we cannot reasonably verify your identity, we may be unable to fulfill the request.
Authorized Agents
Where applicable law permits an authorized agent to submit a request on your behalf, we may require reasonable evidence that the agent is authorized to act for you.
We may require you to verify your identity directly with us where permitted by applicable law.
Appeals
Where applicable law gives you the right to appeal our decision concerning a privacy request, you may submit an appeal to [email protected] and identify the request you would like us to reconsider.
We will review and respond to an appeal as required by applicable law.
15. U.S. State Privacy Rights

Depending on the applicable law, these rights may include:
- access;
- correction;
- deletion;
- data portability;
- information concerning categories of personal information processed or disclosed;
- opting out of targeted advertising;
- opting out of sale or sharing;
- limiting certain uses of sensitive personal information; and
- appealing certain privacy decisions.
Where applicable law requires additional disclosures or privacy-choice mechanisms, we will provide them.
We do not represent that every state privacy law applies to FBA Foundry merely because a visitor or customer resides in that state.
Rights will be handled according to the law actually applicable to the request and our business.
16. International Users and Data Transfers
FBA Foundry and the third-party providers we use may process information in countries other than the country in which you reside, including the United States.
Data-protection laws in those countries may differ from those in your jurisdiction.
Where applicable law requires a specific safeguard for international transfers, we will use an appropriate legally recognized mechanism or other permitted safeguard.
17. Information Shared in Group Programs
If you participate in a community, group mentorship, group coaching session or other shared program environment, information that you voluntarily post or disclose in shared areas may be visible to other participants.
You should not disclose information in a shared environment that you do not want other participants to see.
FBA Foundry cannot control how another participant independently uses information you voluntarily disclose to that participant, although participant conduct remains subject to our applicable Terms & Conditions.
18. Sensitive Personal Information
FBA Foundry does not intentionally request sensitive personal information unless reasonably necessary for a specific legitimate purpose.
Please do not send information such as:
- account passwords;
- complete payment-card details;
- Social Security numbers;
- government identification numbers;
- medical information;
- precise geolocation information;
- biometric information; or
- other highly sensitive personal information
unless we specifically request the information through an appropriate process and there is a legitimate reason for doing so.
19. Age
FBA Foundry Services are intended for adults.
We do not offer our paid Services to individuals under 18 or intentionally collect personal information from them for the purpose of providing those Services.
20. Third-Party Websites and Services
Our websites and Services may contain links to or integrations with third-party websites, applications, software or services.
Those third parties operate independently and may process information under their own terms and privacy policies.
FBA Foundry is not responsible for the privacy, security or data-handling practices of independent third parties.
We encourage you to review the privacy policies of third-party services you choose to use.

personal information may be disclosed or transferred as part of that transaction, subject to applicable law.
Any successor receiving personal information will be subject to applicable legal obligations concerning that information.

Because there is not a single universally applicable standard governing every such signal, we may not respond to general Do Not Track signals unless applicable law requires us to do so.
Where applicable law requires us to recognize a legally recognized opt-out preference signal, such as Global Privacy Control, we will process that signal in accordance with the applicable requirements.
